§ 1 General Terms of Use

The terms “Boxstitch,” “we,” “us,” and “our” as used in these Terms of Use refer to Boxstitch e.U., which is registered company under the Austrian company register number FN 624223a and is located in Austria, 8041 Graz.

The terms “you”, “your” and “customer” which are used in these Terms of Use refer and apply to anyone engaging with or accessing services provided by this website. By accessing, browsing, or using this site, you confirm that you have read, understood, and agreed to abide by these terms and conditions. If you do not agree to these terms, do not use this site. We do not recognize any conditions set by the customer that deviate from or contradict our terms unless we have expressly agreed to them in writing. These terms and conditions serve as a framework agreement that is binding for all future transactions between the parties involved. We reserve the right to modify the terms and conditions governing this website and the products offered. Any changes to these terms will be effective immediately once they are incorporated into the terms and conditions text and published on the website.

§ 2 Production time of Products that are Customized / Made to Order

The estimated production time for made to order products is provided in the product description. While we strive to ensure this estimate is as accurate as possible, we cannot always guarantee that these times are accurate due to factors that are beyond our control, such as material availability, shipping delays, unexpected surges in orders, and other unforeseen circumstances. If you require precise information on the production times or if you need our products sooner than the estimated time frame, contact us to explore expedited options.

§ 3 Dispatch time of Products that are Backordered / Made to Order

Products marked as back-ordered are currently not in stock and need to be sourced by us first. The time required to make these products available for shipping can vary from a few days to several weeks, depending on the specific product. Therefore we recommend contacting us to get you an estimated availability date before placing an order for such items. We cannot guarantee that items that are marked as backordered or made to order can be shipped in case our supplier has ran out of stock or if we cannot aquire any more materials to make such products. If your order includes items that are readily available as well as made to order / back ordered items, your entire order will be shipped once all items are ready to ship. If you wish to receive your in-stock items without any delays, and prefer to have the back ordered / made to order items to be shipped separately once they become available, place two separate orders – Check out or section Shipping & Local Pickup on our website for more information.

§ 4 Ordering

Our product range represents a non-binding offer that is subject to change. Your order constitutes an offer to conclude a purchase agreement and does not form a legally binding contract. The purchase agreement is only concluded when the goods have been shipped by us. We reserve the right to decline any order. If your order is not accepted, we will notify you and provide the reason for the refusal. When placing an order, you agree that all the information provided is truthful and complete. The customer is responsible for any damages resulting from incorrect information provided. The place of fulfillment, as determined by legal requirements, is the location of our headquarters.

§ 5 Payments

Our payment demands are due immediately and must be paid in advance. Our prices include VAT, the exact rate depends on your country and will be calculated during checkout (generally ranges from 0 to 27% VAT). For customers outside the EU, VAT tax will be removed automatically.

§ 6 Image / Color Accuracy and Product Variations

The images on our website are provided to give you a general idea of the appearance of the products you are purchasing. However, please note that these images may not perfectly represent the actual products. Variations in color and appearance may occur due to factors including, but not limited to, differences in monitor calibration, lighting conditions, camera settings, and image processing techniques. Additionally, products that are made to order or customized may differ slightly from their predecessors. These differences may include improved features or variations in craftsmanship such as different stitching methods. These changes are intended to enhance product quality and are a normal aspect of custom-made items.

§ 7 Delivery and Local Pickup

The risk of transport transfers to the customer as soon as the goods are handed over by us to the shipping company. We do not assume liability for transport damage, loss of goods or stolen deliveries. For compensation, please immediately contact our shipping partners to file a claim. Additionally, please contact us so we can provide any necessary information should the postal service require it. Delivery times are outlined in the Shipping & Local Pickup section of our website. They are not guaranteed and refer to the information provided to us by the shipping companies. The delivery time does not include the processing time or any other factors such as the time it takes for customs to clear the package (for non EU countries) etc.

Customs duties may apply to countries outside the European Union. Please check your local laws for compliance and specific regulations. We are not liable for any additional taxes, fees, import/custom duties, or any other charges that may apply. We always fill out the customs form thoroughly for countries that are not part of the European Union to ensure a smooth and quick customs process. In case your refuse to receive the package once a delivery attempt has been made and if the item remains unclaimed by a certain amount of time, the package will either be destroyed or returned to us. In such cases you are responsible to cover any return charges, shipping charges, handling fees etc. and these will be deducted from your refund. If the package is destroyed no refund is possible.

If you select the local pickup option when placing your order, your items will be available for pickup at our office once they are ready. We’ll contact you via email or the phone number provided to arrange a suitable time and place for pickup. If we don’t receive a response or the items aren’t picked up, we will hold them in stock for up to 30 business days. After this period, if no prior agreement or communication has been made, the order will be considered abandoned, and the items will no longer be available. We will refund any items according to the Returns Policy (§9).

§ 8 Order Cancellations

§ 8.1 Prior to dispatch

You may cancel your order at any point prior to dispatch for products that are in stock for a full refund.

For products that are made to order, customized, backordered or sold by length you may cancel your order before production of made to order products, cutting of goods sold by length and sourcing of backordered products has started for a full refund. In such cases we recommend that you contact us immediately if you wish to cancel your order, as cutting of goods sold by length, sourcing of backordered products and production of made to order/customized products typically occurs on the same day that the order was placed.

§ 8.2 After dispatch

If you wish to cancel an order after it has been dispatched, you must return the item(s) in accordance with our returns policy (§ 8).

§ 9 Returns Policy

Products can be returned within 14 days after your order has been delivered. They must be returned in their original, unused condition and packaging. Upon receiving the returned item(s), we will inspect them to ensure they meet our return criteria before issuing a refund. Refunds will be processed through the original payment method within a certain number of days, depending on the chosen payment method. You are responsible for all outgoing and return shipping charges, as well as any additional fees that might apply, such as customs duties or handling fees. Please note that some items are exempt from being returned, such as products that are made to order or customized, products that were backordered, goods sold by length (such as fabric, foam, cord, etc.) and perishable items.

§10 Refunds on Defective or Incorrect Items

If you receive a defective or incorrect item, we will arrange a refund, repair or exchange with no extra shipping costs for you. Please contact us immediately to address the issue.

§ 11 Warranty and Liability

Our warranty covers defects in materials and workmanship under normal use for a specific period from the date of purchase. During the warranty period, if a product is found to be defective, we will either repair or replace it at our discretion without any additional charges. However, this warranty does not cover damages resulting from misuse, accidental damage, or normal wear and tear. It will be explicitly stated in the product description if a product has warranty coverage. Items lacking warranty specifications are not covered by this policy. Liability for personal injury or claims under product liability law is not governed by this warranty but by applicable statutory provisions, which remain in full effect. Furthermore, we are not liable for damages arising from delivery issues caused by unforeseen circumstances beyond our control. If such circumstances lead us to withdraw from the contract partially or completely, claims for damages are excluded, provided we can demonstrate that these circumstances were not due to our fault.

§ 12 Data Protection and Right of Withdrawal

§ 13 Language and Applicable Law

The contract language is German, and exclusively Austrian law shall apply. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded. The contracting parties agree to the jurisdiction of Austrian courts. If the transaction is not a consumer transaction, the court with substantive jurisdiction at the location of our company’s headquarters shall have exclusive jurisdiction over all disputes arising from this contract.

§ 14 Errors, Omissions, and Inaccuracies

Our website or services may occasionally contain typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, offers, product shipping charges, transit times, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information related to the services or on any associated website is incorrect at any time without prior notice (including after you have submitted your order).

§ 15 Third-Party Tools and Services

We may provide access to third-party tools over which we neither monitor nor have control or input. You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations, or conditions of any kind and without any endorsement. We shall not have any liability whatsoever arising from or relating to your use of optional third-party tools. Any use of optional tools offered through the website is entirely at your own risk and discretion, and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). Furthermore, we may offer new services and/or features through the website in the future (including the release of new tools and resources). Such new features and/or services shall also be subject to these Terms and Conditions.

Unless mentioned otherwise, all materials published on this website, including forms, content, texts, groups of elements, logos, pictures, graphics, digital conversions, and other related materials, are either trademarks (registered or not) and/or copyrights, owned and controlled by Boxstitch. No material from this site may be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any form or by any means without prior written authorization from us.
